The World Health Organization (WHO) is proposing significant changes and additions to the existing International Health Regulations (IHR <\/strong>of 2005).
In addition, a draft for a new pandemic treaty<\/strong> between the WHO and its member states has been launched.<\/p>\n

Very important: even the changes to the IHR<\/strong> (even without the new pandemic treaty) can have major consequences. In contrast to the new pandemic treaty, amendments to the IHR can simply be adopted by the executive without the need for ratification by national parliaments. If the IHR amendments are accepted, this will already have a massive impact on all WHO member states and significant consequences for every single person.<\/p>\n

Anmerkungen zur aktuellen Entwicklung bei den IGV (Mai 2024)
<\/strong><\/h2>\n

Der ganze Prozess, in welchem die WHO-Gremien einschneidende \u00c4nderungen der bestehenden IGV und einen komplett neuen Pandemievertrag anstreben, hat die gleichen kritischen Merkmale: <\/span><\/span><\/span><\/span><\/p>\n

Die jeweils g\u00fcltigen aktuellen Entw\u00fcrfe wechseln sich nun immer schneller ab, sie werden schleppend kommuniziert, und sie halten massgebliche Vorgaben f\u00fcr den notwendigen Vorlauf vor Beschlussfassungen nicht ein. Die auf dieser Seite aufgef\u00fchrten und kommentierten \u00c4nderungsvorschl\u00e4ge der IGV orientieren sich an den 308 \u00c4nderungsvorschl\u00e4gen, die im November 2022 ver\u00f6ffentlicht wurden.<\/span><\/span><\/span><\/p>\n

Nun aber haben wir folgende Situation: <\/span><\/span><\/span><\/span><\/p>\n

27. Mai bis 1. Juni 2024: <\/b><\/span><\/span><\/span><\/span><\/p>\n

Die 77. Weltgesundheitsversammlung soll die \u00c4nderungen des IGV beratschlagen und verabschieden. <\/span><\/span><\/span><\/span><\/p>\n

17. April 2024:<\/b><\/span><\/span><\/span><\/span><\/p>\n

Es wird ein neuer Entwurf ver\u00f6ffentlicht. Der h\u00e4tte fristgerecht am <\/span><\/span><\/span><\/span><\/p>\n

27. Januar 2024 <\/b><\/span><\/span><\/span><\/span>vorliegen m\u00fcssen. <\/span><\/span><\/span><\/span><\/p>\n

Damit h\u00e4lt die WHO ihre eigene Verfahrensregel nicht ein, welche in Art. 55 Abs. 2 IGV selbst einen viermonatigen Vorlauf f\u00fcr beschlussf\u00e4hige konsolidierte Textfassungen vorsieht, welche bis dann bei den Vertragsstaaten eintreffen m\u00fcssten. <\/span><\/span><\/span><\/span><\/p>\n

Die WHO bricht damit nicht nur einfach die eigenen Vertragsregeln, sondern verst\u00f6sst auch gegen den Grundsatz in Art. 26 des Wiener \u00dcbereinkommens \u00fcber das Recht aller v\u00f6lkerrechtlichen Vertr\u00e4ge, das die Einhaltung der Bestimmungen nach Treu und Glauben von allen Vertragsparteien verlangt. <\/span><\/span><\/span><\/span><\/p>\n

In der Realit\u00e4t ist noch mit weiteren Anpassungen und Entw\u00fcrfen zu rechnen, welche den Sinn und Zweck obiger Fristbestimmungen ad absurdum f\u00fchren. Macht man sich bewusst, dass es sich um Anpassungen eines bestehenden Vertragswerks handelt, die nach der Ansicht auch des Bundesrates in der Schweiz gar nicht im Parlament diskutiert werden sollen, so ist das Unbehagen riesig. <\/span><\/span><\/span><\/span><\/p>\n

Unter diesen Umst\u00e4nden ist es derzeit kaum m\u00f6glich, den laufend ge\u00e4nderten, intransparent<\/span><\/span><\/span><\/span> verhandelten und keineswegs finalen \u00c4nderungsvorschl\u00e4gen nachzukommen, weshalb wir im<\/span><\/span><\/span><\/span> Moment davon absehen, die Informationen auf der Homepage rollierend nachzuf\u00fchren.<\/span><\/span><\/span><\/span><\/p>\n

Was wir uns aber erlauben, ist, einige der Korrekturen von den Korrekturen farblich abgehoben zu erw\u00e4hnen<\/span>. Es ist wichtig, sich weiter bewusst zu machen, welche Absichten verfolgt wurden und wie viel Widerstand es braucht, um einschneidende Ver\u00e4nderungen zu unterbinden.<\/span><\/span><\/span><\/span><\/p>\n
